Mediating Employment Matters: The Importance of Knowing What You Don't Know

This session is designed for mediators who want to mediate employment disputes but who may not have substantive experience in that area of law. The intention here is to alert mediators to considerations that may in occur in workplace disputes.

Employment law disputes can arise as a result of a wide range of statutory protections and common law. Mediators in this arena are more effective if they realize that these disputes may touch on not only jobs, wages, and compliant employment practices, but also on deeply held views on personal integrity, worth and reputation.

The overlay of regulations and guidelines can seem like a maze to someone approaching employment law for the first time. For newcomers to the area of practice, knowing some of the touchpoints in the law and recognizing some possible areas for disputes may help you mediate these cases with more confidence.
