Starting off with a definition, this session identifies the fundamental goals and objectives of estate planning, explores forms of ownership and beneficiary designations, and explains the significance of title. It also reviews the different types of wills (including living wills) and powers of attorney (including durable powers of attorney and health care powers of attorney), statutory alternatives to wills, and basic transfer tax concepts.

Review important definitions pertaining to non-tax issues, and dive into a discussion of various provisions (including payment of debts and expenses; guardianship; funeral, burial or cremation instructions; and waiver of bond) and clauses (including compensation of executor, presumption of survivorship, and the exordium clause). This presentation also discusses devise of tangible personal property, real property and residuary estate, and other miscellaneous provisions and execution procedures.

  • Kathryn Cook DeAngelo

    Kathryn Cook DeAngelo is Senior Counsel at Collins Family & Elder Law in Charlotte. She joined the firm in August 2021 as Senior Counsel to the Collins Elder Law practice division. She primarily serves in an advisory and consulting role for our associate elder law attorneys who work directly with and represent clients.

    Kathryn is a Certified Elder Law Attorney (CELA) certified by The National Elder Law Foundation (NELF) and has devoted more than 35 years to practicing elder law. When client matters handled by our associate elder law attorneys involve unique or extraordinary issues, she is available to consult and collaborate with the associate elder law attorneys. She also helps educate junior and associate elder law attorneys about elder law topics.

    Kathryn Cook DeAngelo earned her B.A. in Business Education from Marshall University (Huntington, WV), an M.Ed. in Remedial Reading from the University of Maryland and her J.D., magna cum laude, from North Carolina Central University Law School.

    Prior to attending law school, Kathryn was a public school teacher and taught business/secretarial studies for twelve (12) years at DuVal High School in Prince George's County, MD. After graduation from NCCU Law, she had the distinct honor to be selected by the distinguished Henry E. Frye, former Justice and Chief Justice of the North Carolina Supreme Court (first African-American Justice and Chief Justice to sit on the Court), to serve as his Law Clerk 1984-1985. At the conclusion of her clerkship, she moved to Myrtle Beach, SC, and became an associate attorney with the law firm Nettles Floyd Turbeville and Reddick, later becoming a partner in the firm Floyd Prevatte and DeAngelo. In 1990 she established her solo law firm in Surfside Beach, SC. After 34 years of private law practice in she closed her law offices in 2019 to move to Charlotte.

  • John W. Forneris

    John W. Forneris is a member of Robinson Bradshaw & Hinson PA in Charlotte. He practices in the areas of estate planning, estate administration and tax planning. He assists clients with the development of wealth transfer strategies that achieve the clients' personal and financial goals while minimizing the tax and costs associated with the transfer of wealth to younger generations. He also works with clients to preserve and maximize the value of their wealth through the formation of family limited liability companies and charitable gift planning.

    John's experience includes the preparation of federal gift, estate and fiduciary income tax returns and various estate planning documents, including wills, powers of attorney, revocable trusts, irrevocable life insurance trusts, GRATs, charitable remainder trusts and generation-skipping transfer tax-exempt trusts.

    John is a contributing author to the BB&T Estate Planning Forms Manual, a popular resource for North Carolina attorneys.

    John earned his B.A. from the University of Virginia and his J.D., magna cum laude, from Wake Forest University School of Law.

  • Brooks F. Jaffa

    Brooks F. Jaffa is a partner at Cranford Buckley Schultz Tomchin Allen & Buie PA in Charlotte. He represent clients in a wide range of legal matters including commercial litigation, fiduciary litigation, employment litigation, and federal civil asset forfeiture litigation.

    John was recognized by Business North Carolina's Legal Elite in the category of Tax/Estate Planning and as a "Young Gun" in 2019, having previously been recognized as Young Gun in 2017 and 2018. Brooks was also included in the 2019 Edition of the The Best Lawyers in America in the area of Trusts and Estates.

    Outside of his practice, Brooks is very active in the NCBA. Brooks served as the Chair of the Estate Planning & Fiduciary Law Section's Pro Bono Committee and previously as the Young Lawyer Liaison to the section. He also served on the section's Legislative Committee where he helped draft the North Carolina Uniform Power of Attorney Act.

    Brooks is also a member and current Chair of the Standing Committee on Disaster Legal Services for the NCBA's Young Lawyers Division. In this capacity he has overseen the provision of disaster legal services to victims of Hurricane Florence. Previously he served as the District 9 (NC) Representative (and past Division Director and Committee Chair) for the NCBA's Young Lawyers Division and the American Bar Association Young Lawyers Division. In his role as the District 9 Representative, Brooks organized and led the NCBA's disaster legal services project in which over 175 attorneys provided pro bono legal services to over 400 individuals and families affected by Hurricane Matthew in Eastern North Carolina. For his efforts for with respect to Hurricane Matthew, Brooks received the Younger Lawyer Pro Bono Attorney of the Year Award from the NCBA and the Pro Bono Award for Outstanding Collaborative Project from the Mecklenburg County Bar.

    Outside of his work with the NCBA, Brooks serves as a member of the Board of Directors for Jewish Family Services of Greater Charlotte and Loaves and Fishes.

    Brooks earned his B.A., with distinction, in History and Peace, War, and Defense from the University of North Carolina and his J.D., with honors, from the University of North Carolina School of Law.

  • Judith U. "Judy" Linville

    Judith U. "Judy" Linville is the founder of Linville Law Office PLLC in Charlotte. She brings over 20 years of experience in estate planning, tax, elder law, trust and estate administration, guardianship and general business law.   • David R. Vines

    David R. Vines is a Principal at Offit Kurman in Charlotte. He has been counseling clients with estate, tax and business planning for over 25 years. His experience ranges from preparing relatively simple estate planning documents such as wills and powers of attorney to planning and implementing more sophisticated strategies involving complex irrevocable trusts and family-owned business entities.

    David has assisted his clients with all manner of business succession, asset protection, tax minimization, wealth transfer and philanthropic goals, as well as with both simple and complex estate and trust administration. He also has extensive experience working with ultra-high net worth families in the Family Office arena, having held leadership positions with Multifamily Offices and served as the CEO of a Single-Family Office. He understands the benefits that families with complex structures and multi-generational wealth can obtain by having well-coordinated advice from all of their professional advisors and enjoys working as part of a team in that setting.

    David is also a licensed Certified Public Accountant.
