Federal Asset Forfeiture: "It's not stealing; it's just CAFRA."


When the subject of asset forfeiture comes up, it can be tempting to just throw your hands up in the air. But asset forfeiture has significant consequences for your client that go beyond forfeiting the firearms at the end of the case, and understanding asset forfeiture well enough to use it strategically can give you access to a powerful, although under-used defense tool.

Among other benefits, having a working knowledge of federal asset forfeiture law can make it more probable that your client has the resources to defend himself, may get you access to additional discovery through tactical use of civil discovery tools in parallel civil forfeiture proceedings, and could help you represent innocent owners of seized assets.
